Introduction

These General Conditions of Sale apply between Hélène de Saint Pierre (HSP), hereinafter referred to as the “Company”, and any natural person making a purchase via the www.galerie-hsp.com website, hereinafter referred to as the “Purchaser”.

The purpose of these conditions is to define the terms of distance selling between the Company and the Purchaser, from the order through to payment and delivery. They govern all the stages needed to place an order and monitor the order between the contracting parties.

The placing of an order on the site www.galerie-hsp.com published by the Company implies unreserved acceptance of these conditions.

Purchasers state that they are at least 18 years old and that they are legally entitled to place an order on the Site. Furthermore, the Purchasers are making the purchase for strictly personal requirements.

The General Conditions of Sale are governed by French law. Only the French version of the General Conditions of Sale is legally binding.

Clause 1: Product compliance and availability

The products HSP offers for sale are those shown on the Site on the day the Purchaser visits the Site.

The products are offered for sale while stocks last.

If an error occurs regarding the availability of a product ordered the Company will immediately notify the Purchaser by e-mail. The Purchaser will be refunded for the order within thirty days.

The products offered for sale are described and presented as accurately as possible. The Company’s liability shall not be incurred in the event of an error or omission in the presentation. The photos and texts describing the products are given merely as an indication and have no contractual value. The Company offers products for sale that are manufactured in small series, by craftsmen or handmade: any slight imperfections in the manufacture of a product shall not be considered flaws and will not make the product eligible for repair or replacement.

Clause 2: Price

Prices are given on the Site in Euros including all taxes, including VAT, excluding shipping costs and handling fees.

If the VAT rate is changed, the new rate may be applied to the price of the articles without the internet user receiving any prior notice of the change.

Clause 3: Payment stage

Stage 1: select the product and quantity

Stage 2: identify yourself giving your surname, first name, address and phone number

Stage 3: delivery and invoicing address

Stage 5: online payment, grand total, confirmation of payment

Once the Customer has confirmed the order as above, the Company sends the Purchaser a confirmation e-mail acknowledging receipt of the order. The order will only be considered definitive from when the Company sends the Purchaser the confirmation e-mail and the sale of the product will only become valid as of when the Purchaser pays the corresponding price. The Purchaser also undertakes to pay, or have paid if applicable, directly to the forwarding agent or carrier, the customs duties, VAT or other taxes due when the products are imported into the country of the place of delivery.
The Purchaser will pay for the order by bank card in a secure environment according to the conditions stipulated on the website.

Clause 4: Order

All orders imply the Purchaser expressly and irrevocably accepts the prices and descriptions of the products on sale, as well as these conditions.

Once the order has been confirmed the Company will send the Purchaser a confirmation e-mail to the address given when the order is placed.

Clause 5: Delivery

The products ordered will be sent to the delivery address the Purchaser gives when placing the order.

The handling and shipping costs are inclusive of tax. Purchasers are sent an e-mail notifying them that the order has been shipped.

Clause 6: Availability

If the product ordered is unavailable the Company will notify the Purchaser by e-mail at the address given when the order is placed.

The Purchaser will be refunded for the order within thirty days of payment.

Clause 7: Right of withdrawal

Purchasers have seven clear days from receiving the products in which to exercise their right of withdrawal without having to justify their reasons or pay penalties other than the return shipping costs.

If the seven-day deadline expires on a Saturday, Sunday or a public holiday it is extended to the next working day.

If the right of withdrawal is exercised the Company will refund the Purchaser all the sums paid as soon as possible and no later than thirty days after the date on which the right was exercised.

Clause 8: Returns

The Purchaser has seven days in which to return the product from the date on which the order was received. After this deadline the products delivered will be considered compliant and accepted by the Customer and the Company reserves the right to refuse a refund.

The article must be returned in its original packaging together with the completed return slip.

Clause 9: Guarantees and liability

The risks are transferred on delivery when the products arrive at the delivery address given by the Purchaser. For any claims relative to apparent defects or damage during shipping, the Purchaser must immediately contact the Customer Service Department at: commande@galerie-hsp.com
If the Company duly acknowledges any non-conformities or latent defects the Purchaser will be entitled to ask either for a replacement product or a refund. The Company will pay the shipping costs.

The Company shall not be held liable if it fails to comply with its contractual obligations due to unforeseen circumstances or Act of God as defined by case law.

Clause 10: Personal data

In order to process orders the Company processes personal data on the Purchaser. This data is specified as mandatory on the website forms.
The Company undertakes to keep data provided by Purchasers on the Site confidential and to process it in compliance with the
Data Protection Act of 6 January 1978, as modified and currently in force.
The Company collects and processes the Purchasers’ personal data in order to process orders.
Purchasers may exercise their individual right to access the file, oppose, rectify or delete any relevant data by e-mailing the Company (giving surname, first name and postal address) at
contact@galerie-hsp.com .

Clause 11: Intellectual property

All the components of the site are protected. They are owned solely by the Company. Unless the Company specifically requests otherwise, hypertext links to the website is prohibited. Any person or company that wishes to include a link on its website to the Company’s website must request prior express authorisation from the Company.

Clause 12: Applicable law and jurisdiction

These General Conditions of Sale are implemented and interpreted in compliance with French law. In the event of a dispute the Purchaser undertakes, as a priority, to contact the Company in an attempt to solve any disputes that may arise between the two parties amicably.

If such attempts fail, the French courts will have sole jurisdiction.

Clause 13: Modifications to General Conditions of Sale

The Company reserves the right to adapt or modify these General Conditions of Sale at any time, in which case the General Conditions of Sales in force on the day of order will apply.
